What is the party wall act?
It is an enabling act, intended to ensure that work can progress smoothly, giving rights to the person carrying out the work (Building owner) and their neighbour (adjoining owner).

When do I need to tell my neighbours about the work I intend to carry out?
You must give notice to your neighbour between two months and a year before you plan to start building works.
It is vitally important that the correct notices are served, and all the information contained within is correct. Any errors in the notices can result in delays in starting the works.
What works are covered by
the act?
You must tell your neighbour if you want to:

Build on or at the boundary of your two properties

Work on an existing party wall or party structure

Dig below and near to the foundation level in their property
Examples of this type of work would include:

Building a new wall

Cutting into a party wall

Making a party wall taller, shorter or deeper

Removing chimneys from a party wall

Knocking down and rebuilding a party wall
What happens after I serve notice?
Your neighbour has the option of consenting to the works in writing or dissenting to the works. If your neighbour dissents, the dispute resolution process starts where your neighbour can appoint their own surveyor or use your surveyor as an agreed surveyor to produce a party wall award.

Gary Williams has over 35 years of experience in the construction industry, including 25 years as Director of a local building company, specialising in home extensions and loft conversions.
He studied with the Royal Institute of Chartered Surveyors to become a Home Inspector carrying out home condition reports. More recently Gary has studied with The Party Wall Academy to understand all matters relating to the Part Wall Act and is currently an associate member of the Faculty of Party Wall Surveyors.
